Effective 09 October 2026 · Version 1.0
Terms of Service
The rules that apply when an organization creates, publishes and manages Digital Product Passports with PassEU.
Add the contracting entity, registered address, governing law and dispute forum before launch.
1. Agreement and authority
These Terms govern access to the PassEU website, workspace, APIs and related services. By creating an account, accepting an invitation or using the service, you agree to these Terms on behalf of yourself and, where applicable, your organization.
You confirm that you are legally able to accept these Terms and have authority to bind the organization you represent. If you do not agree, do not use the service.
2. The PassEU service
PassEU provides tools to structure, review, version, publish and share Digital Product Passport information. Features may include public passport pages, stable URLs, QR codes, imports, exports, collaboration and administrative controls.
PassEU is a software provider. It is not a certification body, conformity assessor or legal adviser, and use of the service does not by itself establish compliance with EU or national product rules.
3. Accounts and organizations
- Provide accurate account and organization information and keep it current.
- Protect credentials, recovery methods and API keys, and notify PassEU promptly of suspected unauthorized access.
- Assign roles only to people who need them and review access when team members change.
- You are responsible for activity performed through accounts under your organization, except to the extent caused by PassEU.
4. Customer content and instructions
You retain ownership of product records, files, brand assets and other content you submit. You grant PassEU a limited right to host, process, reproduce and display that content only as needed to operate, secure and improve the service and to follow your publication settings.
You must have the necessary rights and lawful basis to upload and publish the content. You are responsible for its accuracy, claims, supporting evidence, translations and any personal data it contains.
5. Publication and regulatory responsibility
You decide when a passport is ready to publish. Before publication, you should verify required fields, linked evidence, product identifiers, responsible economic operators and any statements presented to the public.
PassEU may provide completeness checks and workflow prompts, but these are product features—not regulatory approval or a guarantee that a passport is complete under every applicable regime.
6. Acceptable use
Do not use the service to break the law, infringe rights, distribute malware, probe security without authorization, interfere with other users, misrepresent product claims, or publish content that is fraudulent, deceptive, abusive or unlawful.
You may not resell access, bypass plan limits, scrape the service at unreasonable volume, or reverse engineer protected parts of the service except where applicable law expressly permits it.
7. Plans, fees and taxes
Paid plans are billed at the price, currency and interval shown at checkout. Published-passport allowances and other limits are described on the pricing page or order form. Draft and archived records are treated as stated in the selected plan.
Fees exclude taxes unless stated otherwise. You authorize recurring charges until cancellation. Price or plan changes will be communicated before they take effect for a renewal period.
8. Service changes and availability
PassEU may improve, replace or discontinue features. We will take reasonable steps to avoid materially reducing a paid service during its current subscription term and to provide advance notice where a change materially affects normal use. Maintenance, security events and circumstances outside reasonable control may temporarily interrupt access.
9. Confidentiality and data protection
Each party will protect non-public information received from the other and use it only for the relationship. This does not cover information that is public through no breach, already lawfully known, independently developed or lawfully received from another source.
PassEU processes personal data as described in the Privacy Policy. Where PassEU processes personal data solely on an organization's documented instructions, the parties may enter into a separate data processing agreement.
10. Intellectual property
PassEU and its licensors retain all rights in the service, software, interface, documentation and trademarks. No rights are granted except the limited right to use the service during the subscription. If you provide feedback, PassEU may use it without restriction or payment, provided it does not identify your confidential information.
11. Suspension and termination
You may cancel a subscription through the billing workflow. PassEU may suspend access where reasonably necessary to address a security risk, unlawful use, overdue undisputed fees or a material breach. Where practical, we will give notice and an opportunity to resolve the issue.
After termination, access ends and customer content will be retained or deleted according to the plan, documented export window, legal obligations and the Privacy Policy. Public passports may be unpublished before deletion.
12. Warranties and liability
The service will be provided with reasonable care and skill. Except for rights that cannot legally be excluded, the service is provided without implied warranties and customers remain responsible for regulatory decisions and published content.
Any exclusions, financial caps, carve-outs and allocation of indirect or consequential loss must be completed by qualified counsel for the contracting entity and target customer group before these Terms are used.
13. Changes, governing law and contact
We may update these Terms to reflect service, legal or security changes. Material updates will be notified in advance where required, and the effective date will identify the applicable version.
The governing law, courts and any mandatory consumer dispute rights will be added after the PassEU contracting entity and launch markets are confirmed. Questions may be submitted through the contact page.
